Welcome to the EverTrack App! These Terms and Conditions outline how you can use the app, participate in referral opportunities, earn rewards, and comply with our guidelines while engaging with Everlast Energy's services.
Introduction
Welcome to the EverTrack App (“App”), developed and owned by Everlast Energy (“Company”). By using the App and participating in its referral features, you (“Participant”) agree to these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use the App or participate in the referral program.
Definitions

Referrer: A current user of the EverTrack App who shares a unique referral link or code to invite others to become customers of Everlast Energy.

Referred User: A new customer who signs a contract with Everlast Energy and successfully has their system installed.

Referral Reward: The monetary incentive paid to the Referrer upon a Successful Referral.

Successful Referral: A referral that results in the Referred User signing a contract with Everlast Energy, completing the installation of their system, and achieving "Permission to Operate" (PTO).
Permission to Operate (PTO): Approval granted by the utility company allowing a solar energy system to be activated and connected to the grid. PTO is the final step in the installation process..
Eligibility
Participation is open to individuals who:

Are at least 18 years old.

Reside in a country where Everlast Energy operates.

Are registered users of the EverTrack App.
-
Employees, contractors, or affiliates of Everlast Energy, and their immediate family members, are not eligible to participate in the referral program.
How the App Works
Referrer:

Referrers can share their unique referral link or code through the EverTrack App with friends, family, or acquaintances.

A Successful Referral occurs when:
-
A Referred User signs a contract with Everlast Energy.
-
The Referred User completes their system installation and receives PTO from the utility company.
-
Rewards are distributed 14 days after PTO is granted.
Referred User:

To qualify as a Referred User:
-
The individual must not have previously been a customer of Everlast Energy.

They must sign a contract with Everlast Energy using the Referrer’s unique link or code.

They must complete the installation of their system and receive PTO.
Rewards:

Referrers will receive the following incentives:
-
$500 for their first Successful Referral.
-
$750 for their second Successful Referral.
-
$1,000 for their third and all subsequent Successful Referrals.

Rewards are paid via wire transfer, cash, or check, depending on the payment method selected by the Referrer in the EverTrack App.

If a Referrer does not select a payment method within 60 days of being notified of a reward, the reward will expire.
Payment Timeline:

Payments are typically issued 2-3 months after the initial referral submission, as the process includes system installation and PTO approval.
Prohibited Activities
Participants must not:

Create fake or duplicate accounts to exploit the App or its features.
-
Use unauthorized or spammy channels to share referral links or codes.
-
Misrepresent the referral program or its benefits to potential Referred Users.

Violate local laws or regulations in connection with the App or referral activities.
Everlast Energy reserves the right to investigate and take action, including withholding rewards or terminating accounts, for violations of this section.
Reward Limits and Expiration

There is no limit to the number of referrals a Participant can make per month.

Referral rewards do not expire unless the Referrer fails to select a preferred payment method within 60 days of being notified.
Taxes
Participants are responsible for reporting and paying any applicable taxes associated with rewards received through the App. Everlast Energy does not provide tax advice and recommends consulting a tax professional.
Modification and Termination
Everlast Energy reserves the right to:

Modify these Terms or the App’s features at any time without prior notice.

Terminate the App or its referral program at their discretion.
Changes will be effective immediately upon posting on the EverTrack App or website. Continued participation constitutes acceptance of such changes.
Privacy

By using the App, you agree to the collection and use of your personal information in accordance with the Everlast Energy Privacy Policy.

Data collected may include:

Your name and contact information.
-
Referral activity (e.g., links shared, rewards earned).

Dispute Resolution

Any disputes arising from the App or its referral features will be resolved in accordance with the laws of the State of Connecticut, USA.

Participants waive the right to bring class action claims and agree to individual arbitration or small claims court.
Limitation of Liability

Everlast Energy is not liable for:

Delays or issues caused by utility companies in granting PTO.
-
Technical problems preventing referral submissions or payments.
-
Unauthorized or fraudulent actions by other users.
